Courts Act 2004 - Key Changes by Date
Key Changes from 20th September 2004:
- Letter of claim within 2 months of the accident (Section 8)
- Courts when assessing cases shall have regard to the PIAB book of Quantum (Section 22)
- It becomes an offence to give false evidence (Section 25). Note this applies to outstanding claims as well as new. Penalties introduced (Section 29)
- Case can be dismissed if evidence given that is false or misleading. (Section 26)
Key Changes from 31 March 2005:
- Statute of Limitations period reduced to 2 years from commencement of Act or 3 years from date of cause of action whichever is first (Section 7)
- Personal Injuries Summons with specified information (Section 10)
- Information on all previous cases must be given as well as details of injuries and treatment and of earnings (Section 11)
- The plaintiff must swear an affidavit verifying allegations made within 21 days. If the defendant makes assertions or allegations in response they too must swear an affidavit. (Section 14)
- A court may direct that Mediation Conferences take place (Section 15)
- Account to be taken of any charitable gift made by the defendant following death or injury (Section 27)
- Rules relating to “In Camera” hearings (Section 40)
